2. Service Description and Acceptance

ScreenHelp.ai provides AI-powered screen analysis services through a web platform and browser extension. By using our service, you agree to these Terms of Service and our Privacy Policy.

Service Components:

  • AI-powered screenshot analysis via third-party AI services
  • Browser extension with keyboard shortcuts
  • Live sharing sessions for cross-device access
  • User authentication and prompt storage
  • Free and paid subscription plans

Age Restrictions: You must be at least 16 years old to use this service. Users under 16 require explicit parental consent.

3. User Accounts and Responsibilities

Account Creation: You must provide accurate information during registration and maintain account security.

User Responsibilities:

  • Maintain confidentiality of login credentials
  • Use the service in compliance with applicable laws
  • Respect intellectual property rights of others
  • Use AI features responsibly within usage limits
  • Report security vulnerabilities or service abuse

Prohibited Uses:

  • Illegal activities or violation of applicable laws
  • Harassment, discrimination, or harmful content creation
  • Attempts to reverse engineer or compromise the platform
  • Misuse of AI outputs for deceptive or fraudulent purposes
  • Automated scraping or excessive API usage
  • Creating competing services using our platform or data
  • Processing copyrighted content without authorization

4. AI Service Disclaimers and Limitations

AI Output Accuracy: Our AI analysis is provided "AS IS" without warranties of accuracy, completeness, or fitness for any particular purpose. AI outputs may contain errors, biases, or inaccuracies.

User Verification Required: You must independently verify all AI-generated results before relying on them for important decisions. We disclaim liability for damages resulting from reliance on AI outputs.

Automated Decision-Making: Our service uses AI to analyze screenshots and provide recommendations. These are suggestions to assist you - you retain full control over actions taken.

Third-Party AI Processing: Screenshots are processed through third-party AI services subject to their terms and policies. We do not control or guarantee the availability or performance of third-party AI services.

5. Intellectual Property Rights

User Content Ownership: You retain ownership of all screenshots, prompts, and personal data you provide ("Input Content"). You own all AI-generated analysis and outputs based on your Input ("Output Content").

Platform License: You grant us a limited, non-exclusive license to:

  • Process your screenshots through AI services solely for providing our service
  • Use aggregated, anonymized data for service improvements
  • Store and transmit your content as necessary for service delivery

Platform Intellectual Property: All platform technology, software, algorithms, and proprietary methods remain our exclusive property. You receive a limited, revocable license to use the service.

6. Payment Terms and Subscriptions

Payment Processing: Payments are processed by Stripe, Inc. By providing payment information, you agree to Stripe's Services Agreement and relevant payment network terms.

Subscription Billing:

  • Current plan details and pricing are available at https://screenhelp.ai
  • Automatic renewal unless cancelled before billing cycle ends
  • Plan changes take effect at next billing cycle (no pro-rating)
  • Failed payments may result in immediate downgrade to free plan
  • All fees are in USD and exclude applicable taxes
  • Invoices will be sent to your registered email address within 24 hours of payment

Subscription Changes: We may modify subscription prices, features, or terms with 30 days' advance notice to active subscribers. Changes take effect at your next billing cycle.

Fair Use Policy: Plans described as "unlimited" are subject to fair use limitations to ensure service quality for all users. Usage is monitored over rolling 7-day periods, with reasonable limits applied to prevent abuse. We guarantee a minimum of 300 requests per 7-day period for paid plans, with typical usage allowances significantly higher. Sustained usage patterns that may impact service performance for other users may result in temporary rate limiting.

7. Refund Policy

Limited Refund Policy: Refunds are provided only for documented service failures, including:

  • Failure to deliver core paid functionality as described on our website
  • Service failures meeting our SLA refund criteria

No Refunds For: User dissatisfaction, change of mind, or user error. All sales are final except for qualifying service failures.

Refund Process: Refund requests must be submitted via email to support@screenhelp.ai within 30 days of the billing date with documentation of service failure. Processing time is maximum 30 days.

8. Service Level Agreement (SLA)

Uptime Commitment: We target 99% service availability (excluding planned maintenance with 24-hour notice).

Service Credits:

  • 99% - 95% availability: 10% monthly service credit upon request
  • 95% - 90% availability: 25% monthly service credit upon request
  • Below 90% availability: 100% monthly service credit OR full refund of affected billing cycle (user's choice), upon request

Credit Requests: Service credits must be requested via email to support@screenhelp.ai within 30 days of the availability issue. Processing time is maximum 30 days. Credits are applied to your next billing cycle.

9. Privacy and Data Protection

Data Processing: Our processing of your personal data is governed by our Privacy Policy (https://screenhelp.ai/privacy), which forms part of these Terms and contains detailed information about your data rights, retention periods, and how we handle your information.

10. Browser Extension Terms

Extension Functionality: The purpose of our browser extension is listening for user-configured keyboard combinations and forwarding these events to open ScreenHelp.ai web application tabs. The extension does not capture screenshots, access webpage content, or collect browsing data.

Extension Permissions: The extension requests minimal permissions necessary for:

  • Detecting user-configured keyboard shortcuts
  • Communicating with ScreenHelp.ai web application tabs
  • Storing user's keyboard shortcut preferences locally

User Control: You have complete control over which keyboard combinations the extension monitors. All keyboard shortcuts are user-configured and can be modified or disabled at any time through the extension settings.

Data Handling: The extension only processes keyboard events you've specifically configured. No other user activity, browsing data, or webpage content is accessed or transmitted.

Browser Compatibility: The extension is provided "as is" across supported browsers. We are not responsible for browser-specific issues, incompatibilities, or differences in keyboard handling between browser platforms. Extension functionality may vary between different browsers and operating systems.

11. Limitation of Liability

LIMITATION OF LIABILITY: TO THE MAXIMUM EXTENT PERMITTED BY LAW, OUR AGGREGATE LIABILITY SHALL NOT EXCEED THE AMOUNT PAID BY YOU FOR THE SERVICE IN THE 12 MONTHS PRECEDING THE CLAIM OR €100, WHICHEVER IS GREATER.

EXCLUDED DAMAGES: WE ARE NOT LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR EXEMPLARY DAMAGES, INCLUDING LOST PROFITS, GOODWILL, USE, OR DATA.

AI Service Limitations: We disclaim liability for AI output accuracy, third-party service availability, or decisions made based on AI recommendations.

12. Termination

User Termination: You may cancel your account at any time by contacting support@screenhelp.ai.

Our Termination Rights: We may terminate accounts for:

  • Breach of these Terms with 30-day cure period
  • Immediate termination for illegal use or security threats
  • Non-payment results in downgrade to free plan, not termination

Effect of Termination: Upon termination, your data will be deleted within 30 days (except as required for legal compliance). You have 30 days to request data export via support@screenhelp.ai before deletion.

13. Governing Law and Disputes

Governing Law: These Terms are governed by Czech Republic law without regard to conflict of law principles.

Jurisdiction: Disputes shall be subject to the exclusive jurisdiction of Czech courts, except where EU consumer protection laws provide otherwise.

EU Consumer Rights: Nothing in these Terms affects your statutory rights as an EU consumer.

14. Changes to Terms

We may update these Terms with 30 days' notice for material changes. Continued use after effective date constitutes acceptance of modified Terms.
